In 2006 I verified some of the Rutherford is EEBO or was at that time.

It seems legitimate. The creation date is 2005, the copyright date is 2008; I'm not sure I put too much stock in the "we'll up our prices" threat. Go ahead and get it, then let us know if it's a good deal or not.

It means that it's likely the PDFs are taken from EEBO and being sold by the folks who sell the Amazing Christian Library.
I'm not sure that means that permission wasn't granted by EEBO to sell those PDFs, but it seems quite likely that it's NOT legitimate.
I checked into this when I got some of the Rutherford CDs on ebay in 2006. Whether they know it or not the CDs then had EEBO files; and they were altered to try to disguise that fact. I contacted Proquest (owner of EEBO) at the time and never heard back. If they don't care it's hard to insist on any course; but asking is a good idea if there are concerns (and having looked at them then, I had concerns).

I have found that if a man is involved in a violation of one of the commandments (8th), then he generally will not have a problem with violating another one (9th).
That is why I would ask disinterested parties.
For the record, I'm not saying he's violating either; I just want to be careful with "good deals" like this.
